1. Introduction
These terms and conditions (the “Terms”) govern the US$500 $SOL promotional giveaway (the “Giveaway”). By entering into this Giveaway, you agree to the Terms contained herein, and the terms and conditions accessible at www.travala.com/terms-and-conditions (“Website Terms”). The Giveaway is offered by Travala Pte. Ltd., a company incorporated in Singapore with its registered address at 160 Robinson Road, #14-04 Singapore Business Federation Center, Singapore 068914 (“us”, “we”, “our”, or “Travala.com”). In these Terms, references to “you” or “Participant” shall mean any person that enters into or participates in this Giveaway.
2. Eligibility
The Giveaway is open to residents of all jurisdictions, except where federal, state, or local laws prohibit residents from entering this Giveaway, and is void to the extent prohibited by applicable law. Participants must be over eighteen (18) years of age to enter the Giveaway. Our employees, contractors, subsidiaries, affiliates, suppliers, partners, and directors, as well as the immediate family members of the aforementioned persons, are ineligible to participate in the Giveaway.
3. Entry Period
The Giveaway begins on 23 January 2025 at 7:00 AM UTC and concludes on 31 March 2025 at 6:59 AM UTC (“Entry Period”). To enter into the Giveaway, entries must be received within the specified Entry Period, as determined by the timestamp of the transaction in Travala.com’s booking system.
4. How to Enter
Eligible Participants can enter the Giveaway by creating or signing in to their Travala.com account during the Entry Period via the following link:
Each Participant may only have a maximum of one (1) entry into the Giveaway. By signing in via the link, all Participants will also receive US$50 in Promo Credits to use on any hotel, flight or activity booking that meets the minimum spend requirements outlined in the Travel Credit & Promo Credit Terms and Conditions. Promo Credits are valid for thirty (30) days from the date that they are claimed and added to your Travala.com account.
5. Odds
The odds of winning the Giveaway depend on the total number of eligible entries received. Since each Participant is limited to one (1) entry, all entries have the same and equal odds.
6. Prize
One (1) Participant whose entry qualifies will be selected via a lucky draw to win this Giveaway (the “Winner”). The Winner will receive US$500 in $SOL (the “Prize”) that will be credited to the Travala.com account utilised by the Winner. The Prize will be credited to the Winner’s Travala.com account within fourteen (14) days of the Entry Period concluding.The Prize will be calculated using the prevailing market exchange rate between $SOL and USD at the time of crediting, determined at our sole discretion.
The Prize will not be substituted for cash, another cryptocurrency, or any other form of consideration under any circumstances. Such requests may result in the forfeiture of the Prize, at our sole discretion.
The Winner, upon acceptance of the Prize, shall be solely responsible for all taxes, expenses or costs related to the Prize, including without limitation any and all local, state, and federal taxes. The Winner is advised to consult with a tax professional regarding his or her obligations. No tax advice or assistance will be provided by us.
7. Selection and Notification of Winner
The Winner will be selected by a random draw out of all eligible entries and will be notified by email within fourteen (14) days of the conclusion of the Entry Period. The email will be sent to the Winner’s Travala.com account email address used to sign up or sign in during the Entry Period.
We are not responsible for, nor shall have any liability for, a Winner’s failure to receive notifications due to email security settings that may cause notifications to be marked as spam or junk email, or a Winner’s provision of incorrect, outdated, or otherwise non-functioning contact information.
If a Winner is found to be ineligible or illegitimate, in violation of these Terms or the Website Terms, or if the Winner fails to respond to our email within fourteen (14) days of the email communication, the Prize may be forfeited, and an alternate Winner may be selected. Receipt of the Prize offered in the Giveaway is upon the condition of compliance with any and all federal, state, and local laws and regulations.
IF THE WINNER VIOLATES ANY OF THESE TERMS, OR THE WEBSITE TERMS, THE WINNER (AT OUR SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL RIGHTS AND CLAIMS OF THE WINNER WILL BE IMMEDIATELY NULL AND VOID.
8. Rights We Reserve
We reserve the right to cancel the Giveaway or amend these Terms at any time and without prior notice. We also reserve the right to refuse, withdraw, or disqualify any entry at any time at our sole discretion, including but not limited to where individuals tamper with or attempt to tamper with the operation or entry process of the Giveaway, or otherwise violate these Terms or the Website Terms. By entering this Giveaway, you represent and warrant that you are eligible to participate in the Giveaway and agree to accept our decisions as final and binding as they relate to the rules of this Giveaway.
9. Limitation of Liability and Indemnity
By entering this Giveaway, you agree to indemnify, release, and hold harmless Travala.com, its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, contractors, and officers from and against any and all claims, liability, losses, damages, deficiencies, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of any kind (including, without limitation, reasonable attorneys’ fees and the costs of enforcing any indemnification under these Terms) arising out of or in connection with (i) your participation in the Giveaway; (ii) the acceptance, possession, use, or misuse of any awarded Prize or any portion thereof; (iii) any technical failure, including but not limited to issues with transmissions, phone, or internet service availability; (iv) unauthorised interference or tampering with the any part of the entry process or the Giveaway; or (v) any electronic or human error in the administration of the Giveaway or the processing of entries.
10. Governing Law
THESE TERMS AND THE GIVEAWAY ARE GOVERNED BY AND SHALL BE CONSTRUED IN ACCORDANCE WITH THE LAWS OF SINGAPORE. You agree, as a condition of participating in this Giveaway, that if any dispute, controversy or claim between you and us and/or our subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, contractors, and officers, arising out of or in connection with these Terms and the Giveaway (“Dispute”) shall first be attempted to be resolved confidentially and in good faith by Contacting Us. If the Dispute cannot be resolved through such manner, the Dispute shall be individually resolved exclusively before the courts of Singapore without regard to any choice or conflict of laws rules, without resorting to any form of class action.
11. Privacy Policy
Any data or information that you submit in connection with this Giveaway shall be subject to and processed in accordance with our Privacy Policy.
